The Electrical Trades Union (ETU) of Western Australia strongly condemns Austal Ships Pty Ltd's recent actions denying Mr. Adam Woodage, ETU organiser, his lawful right of entry to premises where ETU members sought to exercise their rights under the Fair Work Act 2009 (Cth).
In a recent court decision (Order dated 23 July 2024, Perth), Justice Colvin declared multiple instances where Austal Ships Pty Ltd. obstructed Mr. Woodage's attempts to enter premises, hindering the legitimate exercise of union rights. These actions, taken on various dates in August and September 2021, were found to contravene sections 501 and 502(1) of the Act.
Mr. Woodage, acting within his legal rights and obligations as an ETU Organiser, sought to organise and support workers during their petition signing process, only to be unlawfully obstructed by Austal Ships. The Federal Court's decision underscores the seriousness of denying union officials access to worksites and the legal repercussions that follow.
"This court ruling sends a clear message to all employers," said Mr. Woodage. "Attempts to deny union entry and obstruct our efforts to support and organise workers will not be tolerated. We will pursue every legal avenue to uphold our members' rights and ensure fair industrial outcomes."
The court has ordered Austal Ships to pay penalties totalling $80,000 for the contraventions, highlighting the severity of their actions. The ETU reaffirms its commitment to protecting workers' rights and will continue to advocate vigorously for fair treatment and workplace democracy.
